Wayne has a general business practice, with an emphasis on labor and
employment law issues, and has been advising and representing Northwest
employers in all areas of employment and traditional labor law for over
30 years. He has specialized in employment and labor law since the early
1970's, when he began his legal career with the Portland, Oregon City
Attorney's office. His traditional labor law experience includes
National Labor Relations Board representation and unfair labor practice
proceedings, union election campaigns, collective bargaining
negotiation, grievance processing and arbitrations. Wayne's practice
also includes advising employers regarding wage and hour issues,
employment discrimination, harassment and retaliation claims,
affirmative action, unemployment benefits, OSHA compliance,
non-competition agreements, and employment, tort and benefits
litigation.
Wayne is a frequent speaker and author on labor and
employment issues. He has been a featured speaker at programs presented
by the Oregon State Bar, Federal Bar Association, National Education
Network, Oregon Bureau of Labor and Industries, Civil Rights Division,
Oregon Medical Association and Workers Compensation Claims Association.
He has presented numerous management and supervisory training sessions
in all areas of Employment Law, including At-Will Employment, Wrongful
Discharge, Employment Discrimination, Discipline and Discharge, Sexual
Harassment, Drug and Alcohol Policies, Americans With Disabilities Act
and Family and Medical Leave Act, and has been co-presenter for 20 years
of a biennial Legislative Update for employer association members. He is
co-author of the "Labor Disputes" chapter of the Oregon State Bar
publication, "Labor and Employment Law: Private Sector" (1990, 1994,
1997, 2002 editions) and co-author of the "Labor Arbitration - Private
Sector" chapter of Oregon State Bar's "Arbitration and Mediation" (1987
and 1992 editions). He is also a contributing author to the American Bar
Association reports on Family Medical Leave Act Developments (current)
and Fair Labor Standards Act Developments (current). Wayne is listed
among The Best Lawyers in America in the area of Labor and Employment
Law and was named an Oregon Super Lawyer. He currently serves on the
Labor Lawyers Advisory Committee of CUE, Inc., an organization for
positive employee relations.
He is an active member of the Oregon, Washington and
Wisconsin state bars as well as numerous federal bars, including the
United States Supreme Court. He has served on the Oregon State Bar
Committee on Uniform State Laws, Labor Law Section Executive Committee,
Diversity Section Executive Committee, and Fee Arbitration panel. He has
also served as a member of the Multnomah Bar Association Judicial
Screening Committee and Profession and the Justice System Committee. He
has served as a mentor in the MBA Mentor Program since its inception and
currently serves on its Professionalism Committee.
Wayne received his B.A. (cum laude) and J.D. (cum
laude) degrees from the University of Wisconsin - Madison, where he was
Weymouth Kirkland Scholar and Note and Comment Editor of the Wisconsin
Law Review. He has served as a law clerk for the Oregon Court of
Appeals, adjunct professor of Employment Discrimination Law at
Northwestern School of Law, Lewis and Clark College, and Deputy City
Attorney for the City of Portland, Oregon. He has been an arbitrator for
over 20 years, including appointment to the permanent non-industry panel
of the New York Stock Exchange.
Wayne is an Eagle Scout and has been active in Scouting
(including the National Eagle Scout Association) for many years. He was
a youth soccer coach for 15 years. He also served for a number of years
on the Board of Directors of the Portland Youth Philharmonic Orchestra,
America's first youth orchestra, including two years as president and
currently serves on the Board of Friendly House, Inc. Wayne is married
and has three grown sons.
